As real estate attorneys, a large part of our practice concerns law use matters, including:

  • zoning and re-zoning,
  • applicable use interpretations with respect to land use restrictions,
  • zoning variances and exemptions,
  • platting,
  • easements, and
  • building code compliance.

In matters concerning real estate acquisitions, we advise clients concerning whether current land use is permissible under applicable law, as well as whether any contemplated uses are permissible.  In many situations, contemplated uses will require re-zoning or obtaining variances or other exemptions with respect to the contemplated uses.

It is important that land buyers clearly understand any and all restrictions upon the use of the targeted land prior to purchase, as well as any third party rights that may exist.  By engaging in pro-active counsel with clients at the outset of a contemplated acquisition, we can carefully make sure that there no unknown restrictions that might prohibit the contemplated land use.

Often, issues arise concerning environmental habitats and compliance with antiquities laws with respect to land that has not been previously developed.  We guide clients through the required compliance process, and often work with external consultants who may take on this work.
